Elements Membership

These Terms & Conditions govern membership of the Elements community and access to Elements events, activations, digital platforms, benefits and related services.
By applying for, purchasing or maintaining an Elements Membership, the member confirms that they have read, understood and accepted these Terms & Conditions.

Throughout these Terms, “Elements”, “we”, “us” and “our” refer to ELEMENTS COMMUNITY, S.L.
Elements is a private wellness and lifestyle community offering members access to curated wellness experiences, activations, events, community experiences, benefits, partner offers and other services made available through Elements.
Membership is personal and non-transferable.
The specific benefits, pricing and conditions applicable to each membership plan will be those communicated to the member when joining.
Elements may periodically introduce, replace or modify experiences, facilitators, venues, partners and membership benefits as the community evolves, provided that such changes do not materially deprive members of the essential service they purchased.
Where a membership includes one activation per month, the member may book one eligible Elements activation during each membership month, subject to availability.
The following conditions apply:
Bookings must be made through the official Elements membership platform, application or another booking method expressly communicated by Elements.
A reservation is confirmed only once the member receives booking confirmation.
Members are responsible for ensuring that their personal and contact information is accurate and up to date.
Because Elements experiences have limited capacity, members should only reserve experiences they reasonably intend to attend.
Members may cancel a confirmed activation up to 12 hours before the scheduled start time without penalty.
Cancellations must be made through the booking system or through another cancellation method communicated by Elements.
A cancellation made less than 12 hours before the scheduled start time is considered a late cancellation.
A €20 fee will be charged when:
By maintaining an active Elements Membership and booking an activation, the member acknowledges and accepts this cancellation policy.
Where technically available, the member authorises Elements to charge the €20 late cancellation/no-show fee to the payment method associated with their membership.
The policy exists because Elements experiences have limited capacity and a confirmed reservation prevents another member from using that place.
If Elements cancels an activation, no late cancellation or no-show fee will apply and the member will retain their included activation.
The applicable membership fee, initial application or joining fee, billing frequency and any other applicable charges will be communicated to the member before joining.
Membership fees are charged according to the applicable membership billing cycle.
The member is responsible for maintaining a valid payment method and ensuring that membership payments can be successfully processed.
Failure to make a required payment may result in the temporary suspension or termination of membership and access to membership benefits.
Membership will continue and renew according to the applicable billing cycle unless the member submits a cancellation request in accordance with Section 9 below.
By maintaining an active membership, the member authorises Elements and its payment provider to process the applicable recurring membership charges using the payment method associated with the account.
All membership cancellation requests must be submitted by email to: membership@elementsmadrid.com
Members wishing to cancel must submit their request during the month prior to the month in which they wish their membership charges to stop.
For example, if a member does not wish to be charged for October, their cancellation request must be received during September.
If the cancellation request is not received within the required period, the member will remain responsible for payment of the full following month of membership.
Membership fees already charged are non-refundable, except where otherwise required by applicable law.
The member will continue to have access to the applicable membership benefits until the end of the membership period that has already been paid.
Once a membership has been cancelled or terminated, the individual is no longer considered an active Elements member after the applicable membership period ends.
If a former member wishes to join Elements again, they must reapply for membership.
If their new application is accepted, they will be required to pay the initial application/joining fee again, at the rate applicable at the time of rejoining.
Previous membership does not guarantee readmission, membership availability or the same membership price or conditions previously held.
Elements is designed to provide a respectful, safe and positive environment for its community.
Members are expected to:
Elements may suspend or terminate membership in cases involving serious or repeated misconduct, including harassment, discrimination, threatening or abusive behaviour, fraud, misuse of membership benefits, deliberate disruption of experiences or behaviour that creates a safety risk.
Where appropriate, decisions will be made proportionately taking into account the circumstances.
Elements experiences may include activities such as Pilates, yoga, fitness, running, breathwork, meditation, sound healing, cold exposure and other physical, wellness or holistic practices.
Participation in these activities is voluntary.
Each member is responsible for determining whether an activity is appropriate for them and for following the instructions and safety guidance provided by the relevant facilitator.
Members should inform the relevant facilitator of circumstances that may reasonably affect their ability to participate safely and obtain appropriate professional advice where necessary.
Elements experiences and content are provided for wellness purposes and are not intended to constitute or replace medical, psychological, psychiatric or other professional healthcare or treatment.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Elements may occasionally need to change the time, location, instructor, facilitator, programme or other aspects of an activation due to operational requirements or circumstances outside its reasonable control.
Elements will make reasonable efforts to communicate material changes to affected members.
If Elements cancels an included membership activation, the affected member will retain their activation and will be able to use it for another eligible experience, subject to availability.
Separately purchased events, retreats or experiences may be subject to their own booking and cancellation conditions, which will be communicated separately.
Membership is personal and may not be sold, transferred, shared or assigned to another person without prior authorisation from Elements.
Members must not share their membership account or login credentials with another individual.
Members are responsible for maintaining the confidentiality of their account credentials and should notify Elements if they believe their account has been accessed without authorisation.
Elements experiences may be photographed and/or filmed for the purpose of documenting, promoting and communicating Elements, its community, events and activities.
By becoming an Elements member and attending Elements experiences, the member acknowledges that photography and audiovisual recording may take place and, unless the member informs Elements otherwise prior to the relevant experience, agrees and authorises Elements to capture and use their image, likeness and appearance in photographs and audiovisual content, subject to applicable law.
Such content may be used by Elements in connection with:
This authorisation is provided without additional compensation to the member.
A member who does not wish for their identifiable image to be captured or used must inform Elements before attending the relevant experience by emailing: membership@elementsmadrid.com
Elements will take reasonable measures to respect the member’s request and avoid using identifiable images of that member.
Members must also respect the privacy and image preferences of other members when taking or publishing their own photographs or videos during Elements experiences.
The Elements name, trademarks, branding, designs, photographs, videos, written materials, digital content, event materials and other intellectual property are owned by ELEMENTS COMMUNITY, S.L. or used by Elements with appropriate authorisation.
Membership does not grant members ownership of or commercial rights to Elements intellectual property.
Unless expressly authorised, Elements content may not be reproduced, distributed, sold, commercially exploited or represented as belonging to another person or organisation.
Elements processes members’ personal data in accordance with applicable data protection legislation and the Elements Privacy Policy.
Personal information may be processed as necessary to administer membership, process payments, manage bookings and attendance, communicate with members, provide membership benefits, operate Elements services and comply with applicable legal obligations.

Certain Elements experiences and membership benefits may be delivered in collaboration with third-party venues, facilitators, instructors, brands or other partners.
Members may be required to comply with reasonable rules or safety requirements established by those providers when participating in the relevant experience.
Partner benefits and third-party offers may be subject to availability and additional conditions communicated by the relevant provider.
Elements will provide its membership services and experiences with reasonable care and in accordance with applicable law.
Elements is not responsible for losses resulting from circumstances outside its reasonable control or from a member’s failure to comply with reasonable instructions, except where liability cannot legally be excluded or limited.
Nothing in these Terms is intended to exclude, restrict or waive any liability or consumer protection that cannot lawfully be excluded under Spanish law.
Elements may update these Terms & Conditions from time to time to reflect changes to the membership, services, operational requirements or applicable legal requirements.
Where a change materially affects existing members’ rights or obligations, Elements will communicate the change within a reasonable period before it becomes effective where required.

These Terms & Conditions are governed by Spanish law, without prejudice to any mandatory rights available to consumers under applicable Spanish or European Union legislation.
Any dispute relating to the membership will be handled in accordance with the jurisdiction and consumer protection rules applicable under Spanish law.
